Fifth Circuit Court of Appeals Unanimously Affirms Decision In Favor of Positive Software

On January 11, 2006, the United States Court of Appeals for the Fifth Circuit Court of Appeals issued a unanimous opinion in favor of Shore Chan Bragalone LLP's client, Positive Software Solutions, Inc.^The Fifth Circuit Court of Appeals found that the arbitrator should have disclosed a professional relationship he had with a lawyer who appeared before him, because the relationship might have created an impression of possible bias.^The noteworthy Fifth Circuit decision was profiled in a January 23, 2006 article from The Texas Lawyer: Arbitrator's Link To Firm May Have Given Impression of Partiality

The Positive Software appeal was argued by SCB partner Michael Shore.^For additional details of the decision, read the Fifth Circuit's opinion. ^The decision clears the way for a new arbitration, after Shore Chan Bragalone attorneys successfully obtained an order vacating the arbitrator's prior award.^For more information on the background of the case, read United States District Judge Godbey's Memorandum Opinion and Order.

Michael and Judy Shore Make Record Donation to Equal Access to Justice Campaign

January 21, 2006

In his speech as outgoing President of the Dallas Bar Association, Tim Mountz paid a special tribute to Michael and Judy Shore for their generous donations to the DBA's Campaign for Equal Access to Justice.^Before a crowd of over 1,000 Dallas lawyers and their guests at the January 21, 2006 black-tie Dallas Bar Inaugural event, Mr. Mountz publicly thanked Michael and Judy Shore, noting that their generous contributions of $180,000 since 1999 have far outpaced all other donors, and contributed immensely to changing the lives of numerous Dallas-area citizens who could not otherwise afford legal services.

The Campaign for Equal Access to Justice funds the Dallas Volunteer Attorney Program ("DVAP"), an alliance between the Dallas Bar Association and Legal Services of North Texas.^Recognized by the American Bar Association for it's exemplary services, DVAP conducts neighborhood clinics each month at four community locations; specialty clinics - Debt Counseling Clinic, Legal Clinic for the Elderly and Mental Health Clinic, Pro se Divorce Clinic; a referral program to large firms and corporate departments; civil case telephone referrals; and a family law mediation project.

Michael and Judy regretted that they were unable to attend the January 21 event due to what Michael referred to as "a prior commitment to our son and his 'Pinewood Derby' car."

Michael and Judy's generous contributions over the years have been lauded in a series of articles, including: Local Attorneys Strive To Provide 'Justice for All' (Dallas Bar Association Headnotes December 2004); Making Quality Legal Services Available to All (Dallas Bar Headnotes, January 2004); and Making Justice Available to All (Dallas Bar Association Headnotes December 2002).

Texas Super Lawyers are the top 5 percent of attorneys in the State of Texas, as chosen by their peers from nominations made by more than 65,000 attorneys in the state.^A panel of lawyers selected by the editors of Law & Politics Media, Inc. makes the selections through a process designed to identify lawyers who have attained a high degree of peer recognition and professional achievement.^Texas Super Lawyers is a comprehensive and diverse listing of outstanding attorneys, representing a wide range of practice areas, firm sizes and geographic locations.

"We are pleased that our peers in the legal community chose to recognize us with this honor" said Jeff Bragalone, a partner in the firm.

This is the second time that Mr. Shore and Mr. Bragalone were jointly recognized by their peers.^In 2002, both were selected in the inaugural list of "The Best Lawyers Under 40 in Dallas" published by D Magazine (May 1, 2002).^"That list was obviously the most accurate" said Mr. Bragalone, who noted that he was ranked "way above" Mr. Shore.^Mr. Shore attributes the "discrepancy" to "possible tabulation errors and a large-firm bias" in the list.

The Super Lawyers list appears in the October 2005 issue of Texas Monthly magazine and in Texas Super Lawyers magazine, a publication co-produced by the publishers of Texas Monthly and Law & Politics Media Inc.^More information is available at the Texas Super Lawyers website.
